PROMOTION PERIOD: The Café Escapes Love Meter Sweepstakes (the “Sweepstakes” or the “Promotion”) begins on February 7, 2013 at 9am Eastern Standard Time (“EST”) and ends on February 15th at 9am EST (the “Promotion Period”). Individuals who enter this Sweepstakes (“Participants”) hereby agree to be bound by, and adhere to, these Official Rules (the “Official Rules” or “Rules”).

ELIGIBILITY: The Promotion shall be open to individuals residing in any of the fifty (50) United States and the District of Columbia who are at least 18 years of age or older. Employees of Green Mountain Coffee Roasters Inc. (“Sponsor”), VaynerMedia, LLC, Facebook and each of their respective parents, subsidiaries, divisions, affiliates, promotion and advertising agencies and members of their immediate family (spouse, parent, sibling or child and their respective spouses, regardless of where they reside) and persons living in the same household of such employees, whether or not related, are not eligible to enter or win.

Void where prohibited by law. Promotion is subject to all applicable federal, state and local laws. The Promotion is in no way sponsored or endorsed by Facebook.

By entering the Sweepstakes, Participants acknowledge and understand that they are providing certain personally identifiable information to Sponsor and not to Facebook. The information Participants provide will be used for the purpose of the drawings, to notify the winners, for other marketing and promotional purposes as Sponsor shall determine and will be used in accordance with the terms of the privacy policies found at http://www.greenmountaincoffee.com/privacy-policy.

ALL ELIGIBLE PARTICIPANTS ACKNOWLEDGE AND AGREE THAT ALL ENTRIES SUBMITTED IN CONNECTION WITH THIS PROMOTION ARE SUBMITTED ON A NONCONFIDENTIAL AND NON-PROPRIETARY BASIS AND MAY BE USED BY SPONSOR, ITS AGENTS, PARTNERS AND SUBSIDIARIES, FOR ANY AND ALL ADVERTISING AND PROMOTIONAL PURPOSES INCLUDING (BUT NOT LIMITED TO) IN CONNECTION WITH THE PROMOTION, IN PERPETUITY, WORLDWIDE, IN ANY MEDIA NOW KNOWN OR HEREAFTER DEVELOPED.

HOW TO ENTER:

During the Promotion Period, Participants should visit Sponsor’s Café Escapes Facebook Page (www.facebook.com/cafeescapes) and click on the Café Escapes Love Meter application (the “Application”). If you do not already “like” Café Escapes on Facebook, you must first click the “like” button in order to access the Application. Upon entering the Application, Participants will be prompted to vote for his or her favorite flavor variety of Café Escapes. After voting for a favorite flavor variety, Participants should follow the links and instructions to complete and submit the Sweepstakes registration form which may include submitting a valid e-mail address and home address (PO Boxes are not permitted). Alternatively, Participants may enter the Sweepstakes by clicking on a direct link to the Sweepstakes registration form within the Application separate and apart from the voting mechanism as Participants are not required to vote for their favorite flavor variety to enter the Sweepstakes. Voting for a favorite flavor variety does not increase the chance of winning. Limit one (1) entry per person per day during the Promotion Period.

Participants will have an option to automatically share that they “like” Café Escapes on Facebook and/or which flavor variety they voted for. Sending this optional message does not increase the chance of winning and must comply with the Facebook guidelines for sending messages. Any entry or portion thereof that is, in the Sponsor’s sole discretion, obscene, profane, lewd, defamatory, contains any third party materials, or otherwise violates or infringes (or may infringe) any copyright, trademark, logo, mark that identifies a brand or other proprietary right of any person living or deceased (including, but not limited to, rights of privacy or publicity or portrayal in a false light) or entity, sexual in nature, or is otherwise objectionable, will not be considered to be posted on any third party website and may be disqualified from the Sweepstakes.

Participants suspected of using macro, script or other forms of automatic entries which subvert the entry process (as determined by Sponsor, within its sole and absolute discretion) may be disqualified.

The computer clock of the Page’s webmaster is the official timekeeping device of the Promotion.

RANDOM DRAWINGS/ODDS OF WINNING: Individuals who meet the entry requirements (as determined by Sponsor, in its sole discretion) will be placed into a random drawing for the Sweepstakes. Voting for a favorite flavor variety does not increase the chance of winning and a Participant’s failure to vote or select his or her favorite flavor variety will not remove the Participant from the Sweepstakes. The random drawing will be conducted from among all eligible entries received during the Promotion Period. The odds of winning a prize depends on the number of eligible entries received for the Sweepstakes. Limit of one entry per person per day during the Promotion Period. If it is discovered that you have registered or attempted to register more than one time per day or have attempted to register/enter multiple times using multiple identities, Facebook accounts or email addresses, all of your entries will be declared null and void, and any prize you might have been entitled to will not be awarded.

WINNER NOTIFICATION: Sponsor’s decisions are final and binding on all matters relating to this Promotion. Selection of the Winners may be conducted by Sponsor or an independent judging organization upon the consummation of the Promotion Period. Such judges’ and/or Sponsor’s decisions are final on matters relating to this Promotion. The judges or Sponsor will notify the potential Promotion Prize (as defined below) winner(s) via email. The potential winner(s) then must respond to the e-mail address provided to the winner(s) with their full name, date of birth, complete mailing address, email address and any other requested contact information within a time period specified by Sponsor or the applicable prize will be forfeited and an alternate winner will be selected. Sponsor will have no further obligation to potential winners who do not meet the stated deadlines in the Sponsor’s e-mail or direct message.

The Sponsor (or other third party on the Sponsor’s behalf) may (but shall not be required to) send, via email and/or mail, the prize winner(s) an Affidavit of Eligibility, Liability & Publicity Release (“affidavit”). Except where legally prohibited, if an affidavit is sent to the winner(s), such prize winner(s) must then sign and return, via postal mail and/or email, the affidavit, within seven (7) days of being notified in order to claim his/her prize. Each prize winner(s) may be required to complete and sign an additional Liability Release depending on the nature of the prize to claim his/her prize. If a winner (i) cannot be contacted via email after the two (2) attempts to contact him/her within three (3) business days of being selected a winner, (ii) fails to sign and return any release or affidavit within the required time period, (iii) fails to abide by these Official Rules, or (iv) is deemed ineligible, as determined by Sponsor in its sole discretion, that winner will be deemed to have forfeited the prize, and Sponsor will award the applicable prize to an alternate winner selected by a random drawing from among all remaining eligible entries received.

PROMOTION PRIZES AND APPROXIMATE RETAIL VALUES (“ARV”): Six (6) Keurig Single-Cup Brewers will be awarded during the Promotion (Approximate Retail Value (ARV: $101.72) Total ARV of each prize is approximately $610.32. Limit one prize per person/household. Sponsor is not responsible for the allocation and use of prizes. All costs and expenses associated with the prize (including, if applicable, any travel and accommodations expenses), and not specifically described are the sole responsibility of the winner. Winners are responsible for all federal, state, and local taxes and fees associated with prize receipt and/or use. Sponsor will send all winners an IRS Federal 1099-MISC tax form for the retail value of any prize at or above $600. Prizes are not transferable or redeemable for cash and prize substitutions will not be allowed, except at sole discretion of the Sponsor who reserves the right to substitute prizes of equal or greater value. If any prize is a gift card, terms of the applicable gift card apply. If the winner is at least 18 years of age but still considered a minor in his/her place of residence, prize may be awarded in the name of his/her parent or legal guardian, who will be responsible for fulfilling all requirements imposed on winners set forth herein.

GRANT OF PUBLICITY. Without limiting any other provision of these Rules, each prize winner, by acceptance of the prize(s), grants permission for Sponsor and each of their affiliates and licensees to use his or her name, address, photograph and/or other likeness and prize information for advertising, trade and promotional purposes relating to the Sweepstakes without further compensation, in all media now known or hereafter discovered, worldwide in perpetuity and without notice or review or compensation.

GENERAL CONDITIONS AND LIMITATION OF LIABILITY: By participating, each entrant agrees: (a) to abide by these Official Rules and decisions of Sponsor and judges, which shall be final in all respects relating to this Promotion; (b) to release, discharge, indemnify, defend and hold harmless Sponsor, Facebook and VaynerMedia, LLC and each of their respective parents, affiliates, subsidiaries, and advertising and promotion agencies, and the respective officers, directors, shareholders, employees, agents and representatives of the foregoing (individually, a “Released Party” and collectively, the “Released Parties”) from any and all injuries, liability, losses and damages of any kind to persons, including death, or property damage resulting, in whole or in part, directly or indirectly, from entrant’s participation in the Promotion or the acceptance, possession, use or misuse of any awarded prize (including, if applicable, any travel/activity related thereto); and (c) to the use of his/her name, address (city and state), voice, entry, photograph, image and/or other likeness for programming, advertising, publicity, trade and promotional purposes in any and all media, now or hereafter known, worldwide and on the Internet, and in perpetuity by Sponsor and its designees, without compensation (unless prohibited by law) or additional consents from entrant or any third party and without prior notice, approval or inspection, and to execute specific consent to such use if asked to do so.

THE LIMITATION OF LIABILITY PROVIDED ABOVE IS A COMPREHENSIVE LIMITATION OF LIABILITY THAT APPLIES TO ALL DAMAGES OF ANY KIND AND IN NO EVENT SHALL VAYNERMEDIA, LLC, THE SPONSOR, OR ANY OTHER RELEASED PARTY BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF THE PARTICIPATION IN THE SWEEPSTAKES (INCLUDING, WITHOUT LIMITATION, ANY SUCH DAMAGES ARISING OUT OF THE CONTENT OF AN ENTRY FORM AND SUBMISSION).

WITHOUT LIMITING THE FOREGOING, EVERYTHING IN THE SWEEPSTAKES, INCLUDING, WITHOUT LIMITATION, EACH PRIZE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. CHECK YOUR LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS.

No Released Party shall be liable to any Participant (including, without limitation, any prize winner) by reason of any acts of God, act action(s), regulation(s), order(s) or request(s) from any governmental or quasi-governmental entities, equipment failure, terrorist acts, labor dispute or any other force majeure event or cause beyond a Released Party’s reasonable control.

Released Parties are not responsible for misdirected or undeliverable entries and/or tweets or for any technical problems, malfunctions of any telephone lines, computer systems, servers, providers, hardware/software, lost or unavailable network connections or failed, incomplete, garbled or delayed computer transmission or any combination thereof. Released Parties are not responsible for late, lost, damaged, misdirected, incomplete, undeliverable, destroyed, garbled or stolen entries or tweets; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether typographical, human mechanical, electronic, computer, network, printing or otherwise relating to or in connection with the Promotion, including, without limitation, errors or difficulties which may occur in connection with the administration of the Promotion, the posting of statements, the processing of entries and/or tweets, the announcement of the prizes or in any Promotion-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Promotion. Entry materials that have been tampered with or altered are void. Sponsor reserves the right, in its sole discretion, to cancel or suspend part or all of this Promotion at any time without notice and for any reason, including if in the judges’ opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Promotion, or if virus, bugs, non-authorized human intervention or other causes corrupt or impair the administration, security, fairness, or integrity and proper play of the Promotion. In the event of cancellation, Sponsor may void any entries it suspects are at issue and, at its discretion, award the prizes at issue in a random drawing from among all non-suspect, eligible entries received. Caution: Any attempt by an entrant or any other individual to damage the website or undermine the legitimate operation of the Sweepstakes may be in violation of criminal and civil laws and, should such an attempt be made, the Sponsor reserves the right to seek damages and other remedies (including attorneys’ fees) from any such person to the fullest extent permitted by law, including criminal prosecution. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that or any other provision. Sponsor reserves the right to disqualify entrants who violate these Official Rules or interfere with this Sweepstakes in any manner. If an entrant is disqualified, Sponsor reserves the right to terminate that entrant’s eligibility to participate in the Sweepstakes. Released Parties are not responsible for injury or damage to participants' or to any other person's computer or mobile device related to or resulting from participating in this Promotion or downloading materials from or use of the Page or other third party website.

SPONSOR RESERVES THE RIGHT, AT ITS SOLE DISCRETION, TO REMOVE ANY ENTRY OR OTHER STATEMENT THAT IS PUBLICLY POSTED TO THAT THE SPONSOR FEELS IS INAPPROPRIATE, OBJECTIONABLE AND/OR INCONSISTENT WITH THE POSITIVE IMAGE AND/OR GOOD WILL IT WISHES TO PROMOTE IN THIS SWEEPSTAKES.

Sponsor reserves the right in its sole discretion to cancel or suspend any portion of the Promotion for any reason, including should any cause corrupt the administration, security or proper play of the Promotion and, in the event of termination, to determine the winner(s) among all eligible non-suspect entries received up to such time using the winner selection procedure outlined above.

Entry in the Sweepstakes by a minor permitted only where allowed by law and with parental or legal guardian permission. Entry by such minor assumes such permission is granted, and a statement of permission may be required (along with any applicable tax information and statements) prior to release of any Prize for any winners under 18 years of age. Otherwise, a substitute winner will be selected via a random drawing process.

DISPUTES: Except where prohibited, all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the Participants and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of New York, without giving effect to any choice of law or conflict of law rules (whether of the State of New York, or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of New York.

REQUEST FOR WINNERS’ NAMES: For a list of the names of the winners send a self-addressed, stamped, envelope postmarked by March 1, 2013, to SPONSOR: Green Mountain Coffee Roasters Inc., 33 Coffee Lane, Waterbury, Vermont 05676.

FURTHER DOCUMENTATION. If Sponsor shall desire to secure additional documentation as it deems reasonably necessary in order to effectuate the purposes and intents of these Rules, then each Participant agrees to sign the same upon Sponsor’s request therefore.

THE PROMOTION IS IN NO WAY SPONSORED, ENDORSED OR ADMINISTERED BY OR ASSOCIATED WITH, FACEBOOK. FACEBOOK IS COMPLETELY RELEASED OF ALL LIABILITY BY EACH ENTRANT IN THIS CONTEST. Direct any questions/comments/complaints regarding the Sweepstakes to Sponsor, not Facebook.
